When does a commercial lease need to be registered? Modern commercial leases are normally required to be registered if theyre granted for a period of more than seven years. If the period is for less than seven years, then registration typically isnt needed. This is the case for both sub-leases and head-leases.
In New York, to record a memorandum of lease, it must contain: The names and addresses of the landlord and tenant. A reference to the full unrecorded lease. The date of execution of the lease. A description of the leased premises in the form contained in the lease. The lease term, including:
