A Closing Disclosure is a five-page form that provides final details about the mortgage loan you have selected. It includes the loan terms, your projected monthly payments, and how much you will pay in fees and other costs to get your mortgage (closing costs).
In such case, the completed HUD-1 or HUD-1A shall be mailed or delivered to the borrower, seller, and lender (if the lender is not the settlement agent) as soon as practicable after settlement.
While closing disclosures provide information about a borrowers loan, settlement statements do not include loan information. Settlement statements are used for commercial transactions and cash closings.
One common HUD form is the HUD-1 settlement statement, which was previously utilized for a few types of mortgage products but is now used only for reverse mortgages.
The HUD-1 lists all costs related to closing the transaction. Federal law requires the form to be used as a standard real estate settlement form in reverse mortgage and mortgage refinance transactions. Most buyers and sellers review the form with a real estate agent, attorney, or settlement agent.
A HUD-1 or HUD-1A Settlement Statement is prepared by a creditor or, more typically, by the settlement agent who conducts the closing on the creditors behalf.
The Closing Disclosure, or CD, replaced the HUD-1 beginning Oct. 3, 2015.
The HUD-1 form, listing all closing costs, is given to all parties involved in reverse mortgage and mortgage refinance transactions. Since late 2015, a different form, the Closing Disclosure, is prepared for the parties involved in all other real estate transactions.
A closing statement is a form used in a real estate transaction that includes an itemized list of all the buying or selling costs associated with that transaction. Its a standard element of home sales, especially those that involve mortgages, and refinancings.
While the HUD-1 Settlement Statement is largely replaced by the Closing Disclosure these days, it is still used to settle cash transactions, reverse mortgages, and other loans that need not be RESPA-compliant. This is why it is important to understand the HUD-1 Settlement Statement.
