ERISA and the Internal Revenue Code require many employers and plan administrators to submit reports to government agencies and furnish certain plan information to participants. Most 401(k) plan sponsors are required to file an annual Form 5500, Annual Return/Report of Employee Benefit Plan.
The employer maintaining the plan or the plan administrator of a Pension or Welfare benefit plan covered by ERISA. File Form 5500 to report information on the qualification of the plan, its financial condition, investments and the operations of the plan.
A retirement plan that covers only the owner(s) of the company and, if applicable, the spouse(s) of the owner(s) is generally exempt from filing a Form 5500 until the total plan assets are at least $250,000 as of the last day of the plan year.
As explained in the instructions for Form 5500, a plan sponsors health and other welfare plans should be numbered consecutively starting with 501. Pension plans, including 401(k) plans, should be numbered consecutively starting with 001.
What is a plan document? The plan document is a written document that describes the participants rights, benefits, and obligations within the plan, as well as the plans terms and conditions for administering the plan. The plan document should include the Trust Agreement (if applicable) and Insurance Contract(s).
Generally, any business that sponsors a retirement savings plan must file a Form 5500 each year that the plan holds assets.
In general, all employers who adopt and sponsor a retirement plan governed by ERISA such as profit-sharing and 401(k) plans, must file a Form 5500 annually with the DOL.
In the instructions for Form 5500, the IRS informs us that Plan ID numbers are to begin with 501 for a companys first health welfare plan. The second plan is to be numbered 502, a third numbered 503, and so forth.
