[Music] hi and welcome to todays tuesday tip todays tip is going to be on the termination notice you guys know that in the handbook it tells you how to serve the termination notice what many of you are leaving off is the fact that you have to give the vawa notices the 5380 and the 5382 with your termination notice we have time and time again that the termination notices are not served properly because the law notice is not given now i know that every termination does not involve domestic violence but thats not what hood says it doesnt ask us to pick the ones that does and the pick the ones that do not it tells us to give out those two forms with the termination notice so please be aware that we have too many of you who are having to pull back the termination notices and re-issue them because you did not issue them with the vowel notices keep that in mind simple tip simple thing to do thank you and well see you next time on another tuesday tip [Music]

Break Clauses, also known as Break Notices, are provisions written into a commercial lease that allow a landlord or tenant to terminate the lease part way through the term. This is usually at one or more fixed points in time (for example, eighteen months and three years through a five-year lease).
For the landlord, the big advantage of the break clause is that it essentially gives them more time to vet their new tenant. A landlord might choose to include a break clause in a tenancy agreement if theyre unsure about how suitable a tenant might be and want to make sure they have an out.
Notice periods for break clauses are usually two months. So, if you started a 12-month tenancy agreement in January and have a six-month break clause, you would need to give your landlord notice in May should you wish to leave at the six-month point in July.
6 months break clause example It is standard practice to have at least a 6 month break clause term in place. The wording of this 6 month break clause means the landlord or tenant can give notice when they wish, but the earliest date the tenancy can end is after six months.
Our Break Notice Service A break notice in a lease is a notice which either or sometimes both a landlord or tenant can serve on the other to terminate the lease before the contractual expiry date under the lease. There needs to be a contractual right in the lease to terminate it before the expiry date.
