Section 15 of the Charter makes it clear that every individual in Canada regardless of race, religion, national or ethnic origin, colour, sex, age or physical or mental disability is to be treated with the same respect, dignity, and consideration.
The standard age to start the pension is 65. However, you can start receiving it as early as age 60 or as late as age 70. If you start receiving your pension earlier, the monthly amount youll receive will be smaller. If you decide to start later, youll receive a larger monthly amount.
Section 7 of the Charter requires a two-step analysis to determine whether legislation or other state action infringes a protected Charter right: (i) is there an infringement of the right to life, liberty and security of the person; and (ii) if so, is the infringement contrary to the principles of fundamental justice
No law in Ontario requires persons to retire at any age. In theory, employees can work until they no longer wish to do so or are incapable of performing their jobs. However, many workplaces have retirement policies that require all employees to retire at age 65.
However, government action that harms these rights is not enough to violate the Charter. Section 7 is violated only when the government infringes these rights in a way that goes against the principles of fundamental justice.
