Q. What are the basic requirements for rest periods under California law? A. Employers of California employees covered by the rest period provisions of the Industrial Welfare Commission Wage Orders must authorize and permit a net 10-minute paid rest period for every four hours worked or major fraction thereof.
WORKDAY BREAKS Breaks during the work shift allow employees to rest during the working day. Normally they take the form of rest breaks, coffee- or tea breaks and meal breaks. They can also be taken for toilet breaks, prayer breaks or breaks to address other personal needs.
Interpretation. Break means a short period of time during the work period when an employee is released from his obligations to the employer (or is not under the control of the employer) and may freely attend to personal matters in or near his work place.
California Meal Break Rest Break Law (2023) Quick Calculator + Charts. Under California meal break law (which is much more generous to employees than federal labor law), if you are a non-exempt worker, you are entitled to a 30-minute uninterrupted, duty-free meal break if you work more than 5 hours in a workday.
The employee is at least 18 years of age. The employee voluntarily requests to waive the meal period. (For newly hired employees, the request to waive the meal period may not be made until the employee has worked for the employer at least seven days.) The request to waive the meal period is in writing on a form.
Meal and Rest Break Laws for California Employees. If you are a non-exempt employee in California, you must be given a minimum 30-minute lunch or meal break if you work more than 5 hours in a day. The meal break can be unpaid time, and it must start before the end of the fifth hour of the workday.
For example, an employee who works a seven-hour shift is entitled to two 10-minute rest breaksone break for the first four hours, and a second break for the last three hours. Three hours is a major fraction of four hours, meaning more than half of four hours.
Meal Break Obligations In California. You cannot employ someone for a work period of more than five hours without providing an unpaid, off-duty meal period of at least 30 minutes. The first meal period must be provided no later than the end of the employees fifth hour of work.
A. Under California law (IWC Orders and Labor Code Section 512), employees must be provided with no less than a thirty-minute meal period when the work period is more than five hours (more than six hours for employees in the motion picture industry covered by IWC Order 12-2001).
