What types of documents need to be signed in front of a notary? Legal documents: Affidavits and power of attorney forms. Real estate documents: Deeds, mortgages, and lease agreements. The State of Texas requires notaries to verify the identification of every signer. Only valid, non-expired identification, with a photograph is acceptable. These Guidelines are set by the State of Texas, and can be found on the Secretary of States website, and are not at the discretion of your notary.
What other forms of identification can I use? The notary may use either a credible witness or personal knowledge to identify a signer. If you dont know the signer personally, you may take the oath of a credible witness who is personally known to you.
A notary cannot make certified copies of recordable documents. A notary may, however, make a certified copy of a non-recordable document. A non-recordable document is one that cannot be recorded with any type of governmental entity.
Texas law requires an identifying document, such as a drivers license or card relied on by a notary to identify a person must be current. It must be issued by a state or federal government agency and include a photo and signature of the person (TCPRC, Sec. 121.005 and NPEM).
