The most common form of surrender is by an express written declaration by the parties that they are surrendering the lease. If the original lease was one that had to be made by a deed (as is the case when granted for a term of 3 years or more) then the surrender document should also be by way of deed.
Owning a share of freehold If your property is leasehold, you can buy the freehold from the freeholder along with other leaseholders for example, other people living in a block of flats. You can do this if at least half of the leaseholders agree to buy a share.
Statutory position Because a surrender of a lease is not an assignment (or transfer) of a registered estate, it is not a disposition [which] is required to be completed by registration under section 27(2) of the Land Registration Act 2002 (LRA 2002).
Merger may determine a lease when both the lease and the reversion on that lease become vested in the same person and that person holds both interests in the same capacity. However, merger does not arise automatically when that vesting occurs.
A leasehold estate may be extinguished by merger, when the same person becomes entitled to both the leasehold estate and the reversion, or on a surrender of the lease. As in unregistered conveyancing, extinguishment is prevented if the leasehold estate is subject to a mortgage or charge.
To find out how long your lease has left to run you can either check with the solicitor who acted when you bought the property or obtain details of you propertys title from the Land Registry.
Express surrender Form TR1 may be used, but is not essential. Evidence of the landlords consent must also be lodged, whether as a party to the deed or by separate letter.
The landlord and tenant can mutually agree to end the lease at any point. This agreement is called a mutual termination. The mutual termination is a negotiated agreement, and it can end the lease on whatever terms are agreeable to both parties.
If the Lease is not registered at the Land Registry you can still use this form but you may prefer to use the Deed of Assignment of Unregistered Lease instead.
The answer is that it can. As a result, it is permissible, but not necessary, to use form TR1 (or form TP1 in the case of a surrender of part) to effect an express surrender of a registered lease (see HM Land Registry Practice Guide 26).
