- Hey there, this is Seth from the REtipster blog, and in this video, I just wanna give you a really quick overview of what a quitclaim deed is, when it makes sense to use it, and how you can put one together, if thats something you wanna do. (instrumental jingle) So a quitclaim deed is essentially a document that is used to transfer the ownership of real estate from one person or entity to another person or entity. And most of the time when people are buying houses and rental properties and other investments, the most common type of deed that people use is called a warranty deed, and thats a deed where the seller is essentially promising that they have totally free and clear title to the property, and they are conveying it to that new buyer, and theres no title defects on record, so nobody else has any ownership, any liens on the property, or anything that would encroach their totally-unencumbered ownership of that particular property. Under New York law, a deed must be signed with a notary public present and once filed at the County Clerks office the title to the property becomes officially in the new owners name.
Youll need to download and complete Form ID1, which proves your identity when applying for a name change on the title register. Send ID1 with evidence of your change of name (for example, the deed poll document, your marriage certificate or your decree absolute) and AP1 to the Land Registry.
A quitclaim deed transfers the owners entire interest in the property to the person receiving the property but it only transfers what he actually owns, so if two people jointly own the property and one of them quitclaims his interest to his brother, he can only transfer his half of the ownership.
Deeds are required to have the name of the grantor, the name and address of the grantee, the name of the preparer and an acknowledgment by a notary. Once the deed is properly drafted and signed, it must be recorded with the register of deeds in the county in which the property is located.
This depends on whether there is a mortgage on the property and whether both parties are in agreement about the terms. Your solicitor will go through the paperwork, confirm all the details and apply to the Land Registry to change the deeds. If a property has no mortgage, the process can be extremely quick.
Most deeds start with the date. Many people just date the deed the day that it is signed. However, the date on the deed should be the date of transfer of ownership, which is not necessarily the day it is signed.
How to get quit claim deed form? In addition to submitting Form TP-584, which is required by all counties, another form that must be filled out is a 5217 form. Except for NYC, the 5217 form is also required by all counties. NYC has its own version of the RP 5217 NYC or RP 5217 NYC form.
The name change petition can be filed in the County Court or Supreme Court of the county where you live. If you live in New York City, you can file your papers in any New York City Civil Court or the Supreme Court in the county where you live. The Civil Court costs less money than the Supreme Court.
The New York City Real Property Transfer Tax is 1% of the price if the value is $500,000 or less, or 1.425% if it is more. Unfortunately New York State also has a transfer tax. New York State charges you an additional 0.40% transfer tax on the purchase price.
To change the deed in New York City, as we discussed, we will need a deed signed and notorized by the grantor. Additionally, the deed must also be filed and recorded with the Office of the City Register along with transfer documents which identify if any taxes are due.
