​If your roommate is on the lease, the answer is no. Your roommate has as much right to occupy the space as you do. If you want to keep the nonpaying roommate (or anyone else) out by changing the locks, you must get your landlords permission, and youll have to pay the cost.
You can only evict your roommate if they arent on the lease or are your subtenant. Most of the laws relevant to leased apartments in Texas can be found in Title 8, Chapter 92 of the Texas Property Code. This law says that a lease can be oral or written, and can be made between a tenant and a subtenant.
New York allows tenants to their own locks in addition to the locks provided by the landlord. However, tenants need to give landlords a duplicate copy of their key upon request. If they dont, they can be found in violation of their lease and could face eviction.
A common question from both landlords and tenants is whether a landlord can lock someone out of the rental for not paying rent. The answer is yes, but only temporarily and under very specific conditions. They cannot permanently lock the tenant out. The landlord must give the tenant a key upon request.
