Who holds the title deeds? Usually, the original copy of the title deeds is held by the solicitor you used at the time of purchase. However, if a mortgage was required when purchasing a property, then it is possible that your mortgage provider will also hold a copy.
In Florida, when real estate is purchased, the original Deed is recorded in the county recorders office for the county in which the property is located. Once the Deed is recorded, it becomes a public record which, in all Florida Counties, is available for inspection via the internet.
Once the transaction is concluded, the buyer receives the deed in his/her hands at the closing. There are distinct types of deeds, such as special warranty deeds, grant deeds, quitclaim deeds, and bargain sale deeds. In Florida, the most common deed used in home sales is the general warranty deed.
Contrary to normal expectations, the Deed DOES NOT have to be recorded to be effective or to show delivery, and because of that, the Deed DOES NOT have to be signed in front of a Notary Public. However, if you plan to record it, then it does have to be docHubd as that is a County Recorder requirement.
A deed must contain the names of the parties typed or printed to the side or below the signatures. This includes grantors as well as any witnesses and persons taking the acknowledgements. 765 ILCS 5/35c, 765 ILCS 5/9, 5/10. Each county in Florida has a public records website where you can conduct a search. You can use the search filters to narrow the results to deeds, and further filter by grantor/grantee, date of issuance, and other criteria (note that the dates must be exact, not approximate, in order to return accurate results).
Lets get right to the point there is no way of viewing house deeds for free, online or otherwise. So if you need to a copy of a propertys deeds, there will always be a fee to pay.
Obtain Certified Copy of Deed If you have lost or misplaced your original deed (or other legal document which has been recorded), you can obtain a certified copy from the Recording Office where the original document was recorded. A certified copy has the legal validity of the original document.
DEEDS IN GENERAL There are several different essentials to a valid deed: 1. It must be in writing; 2. The parties must be properly described; 3. The parties must be competent to convey and capable of receiving the grant of the property; 4.
