The key difference between being laid off vs. getting fired is that a layoff is the fault of an employer while a firing occurs because of the employees fault. Most workers get laid off because the company is trying to cut costs, reduce the staff, or due to mergers and acquisitions.
An employee on any leave can be dismissed or laid off if the employer suspends or discontinues the business in which the employee was employed. However, if the business operations are resumed within 52 weeks, the employer must reinstate the employee, or provide them with alternative work.
