Lay day is defined as days stipulated for the loading or unloading of cargo from a ship. In other words, the time a ship must docHub the charterer for cargo operations. Lay days are determined by 2 factors, the type and amount of cargo.
There are seven stages in a laytime calculation: Read relevant clauses in the charter party. Obtain Statement of Facts from agent. Determine duration of laytime allowed. Establish time of commencement of laytime. Allow for interruptions to laytime as per the charter party. Establish time of expiry of laytime.
Laycan or L/C - Laydays Canceling - Period during which the shipowner must tender notice of readiness to the charterer that the ship has arrived at the pod of loading and is ready to load, This period is expressed as two dates, for example laydays 25 March canceling 2 April or, when abbreviated as laycan, laycan 25
The days are called laydays (or laytime) and are stipulated in the charter party as working days, weather working days, running days and excepted days. If the charterer loads or discharges his cargo in less time than the number of laydays allowed, he earns dispatch money at so much a day or part of a day saved.
Laydays refers to a period of specified days (e.g. Jan 7/16) during which owners must present the vessel for loading. Laydays should not be confused with laytime, which is the period allowed to the charterers for loading and/or discharging without payment additional to the freight.
LAYTIME shall mean the period of time agreed between the parties during which the owner will make and keep the vessel available for loading or discharging without payment additional to the freight. Each pair of parallel twin hatches shall count as one hatch.
Delay due to a ships condition or breakdown or inability of its facilities to load or discharge cargo does not count as used laytime. Further, where regulations of the owner or port authorities prohibit loading or discharging at night, any time so lost does not count against laytime.
(a) Time for discharging to count from 1300 hours the same Working Day if NOR is given before noon or 0800 hours on the next Working Day if NOR is given after noon during Office Hours, whether the vessel is in berth or not, unless sooner commenced then actual time used in discharging to count.
As far as time charter-parties are concerned, it is true to say that there is no need for laytime and demurrage clauses, since the owner is capable of being paid by the time charterer even if there is no voyage.
In commercial shipping, laytime is the amount of time allowed in a voyage charter for the loading and unloading of cargo. Under a voyage charter or time charter, the shipowner is responsible for operating the vessel, and the master and crew are the employees of the shipowner, not the charterer.
