Small estate affidavits are filed with the Register of Wills. Theyre used to simplify the probate process for estates valued at $50,000 or less. You can view other common probate forms provided by the State of Pennsylvania and the Register of Wills.
Small estate affidavits may be used regardless of whether the decedent had a will. Step 1 Notify Other Claimants. Step 2 Wait Forty Days. Step 3 Fill Out the Form. Step 4 Collect the Property.
To be eligible to use a Small Estates Petition, the value of the decedents personal property in Pennsylvania must not exceed $50,000.00.
First, you must wait at least 40 days after your loved one has died before submitting the affidavit. Second, you are required to mail a copy of the affidavit, along with the decedents social security number, to DSHSs Office of Financial Recovery, whose address is currently: P.O. Box 9501, Olympia, WA 98507-9501.
A formal petition must be filed with the probate court in order to become Administrator of an estate. The petition must also be scheduled for a hearing where the judge can determine, on the record, and in public, whether to appoint as Administrator the person who has filed the petition.
Small Estates: Claiming Assets With an Affidavit If the total value of the probate estate (the assets that cant be transferred to inheritors in another way) is small enough, probate wont be necessary. Currently, Washington allows estates worth up to $100,000 to avoid probate.
Virginia law says a small estate affidavit has to: Provide the name of the person who died and the date of the death. State that the value of the assets in the estate is less than $50,000. State that at least 60 days have passed since the death.
Under RCW 11.20. 010, if you have the original will in your possession and you are the personal representative named in the will, you must file it with the Court no later than 40 days after the testators death, whether you plan to start a probate or not.
In addition, Washington State has one of the simplest probate systems in the nation and can save time and money because: It allows the personal representative to act with authority and without court intervention on nearly all matters. Attorney fees are not based on a percentage of the value of the estate.
Nevada law allows a simplified process for estates that do not include real property (homes or land) and are less than $25,000 (not including the value of vehicles).
