52. (1) The Constitution of Canada is the supreme law of Canada, and any law that is inconsistent with the provisions of the Constitution is, to the extent of the inconsistency, of no force or effect.
One of these was the inclusion of a notwithstanding power in Section 33. This section, often referred to as the notwithstanding clause, allows federal, provincial and territorial parliaments and governments to temporarily override or supersede certain Charter rights.
The notwithstanding clause, or Section 33 of the charter, gives parliaments in Canada the power to override certain portions of the charter for five-year terms when passing legislation.
In 1988, Quebec used the clause in response to a Supreme Court of Canada decision that the provinces law allowing French-only on commercial signs offended freedom of expression because companies could not express themselves in their language of choice.
24. (1) Anyone whose rights or freedoms, as guaranteed by this Charter, have been infringed or denied may apply to a court of competent jurisdiction to obtain such remedy as the court considers appropriate and just in the circumstances.
The notwithstanding clause or Section 33 of the Charter of Rights and Freedoms gives provincial legislatures or Parliament the ability, through the passage of a law, to override certain portions of the charter for a five-year term.
Supreme Court jurisprudence explains the purpose of section 11 generally as protecting liberty and security interests of persons accused of crimes, while noting that it is not the sole source of such protection under the Charter (R. v. Kalanj, [1989] 1 S.C.R. 1594).
