The Federal Circuit concluded that in passing the Patent Act, Congress has determined that only a natural person can be an inventor, so AI cannot be.

A recent Federal Circuit decision, Thaler v. Vidal, made clear that AI cannot be listed as an inventor for purposes of obtaining a patent. The USPTO has published two notices in the Federal Register seeking comments on the status of the laws governing issues related to AI inventorship.
The AI platforms recover patterns and relationships, which they then use to create rules, and then make judgments and predictions, when responding to a prompt. This process comes with legal risks, including intellectual property infringement. In many cases, it also poses legal questions that are still being resolved.
Authorities in the United Kingdom, United States and Europe have taken a similar view. A UK appeals court found that machines are legally incapable of being inventors unlike humans, machines lack legal personality, cannot have rights, and are incapable of holding or transferring property, including patents.
