Like all other forms of evidence, text messages are not automatically admissible in court. They must meet the standards of the rules of evidence. One of the requirements for evidence to be admissible in court is that there be proof that it is authentic.
Generally, contracts that include an offer, consideration, capacity to contract, and acceptance, are deemed valid by the courts. This is the case for written contracts, digital legal documents, or agreements over text, email, or other forms of communication.
California Law: Statute of Frauds and Electronic Signatures Californias Statute of Frauds expressly excludes text messages and similar forms of electronic messages from those writings which may serve as evidence of an agreement.
The issue of whether text messages qualify as writing had not been specifically addressed by the court, but it had previously ruled that writings of relative informality and brevity can be enough to satisfy the statute as long as the writing is sufficiently complete and reflects an intent of the parties to be bound.
It is generally accepted that a text message is not a legally binding contract. This is because the traditional requirements for a contract, such as offer, acceptance, and consideration, are typically not met when a contract is formed via text message.
You cannot send text messages just because you have someones number you have to have consent. The Federal Communications Commission (FCC) enforces rules under the Telephone Consumer Protection Act (TCPA) to protect consumers from unwanted calls or text messages.
A concealment can occur through either purposeful misrepresentation or withholding of material facts. Where the information could not have been known by the other party and it is known to be material by the concealing party, the concealment can give grounds for nullifying the contract.
Once a text message has been sent, it can swing a case. Text messages can often show motives to commit a crime or a persons state of mind during the time of an alleged offence. However, although text messages can be used in court as legal evidence, they arent automatically admissible.
