If you plan to build a deck that is up to 1.5m high, you dont need a building consent but you may still need a resource consent, depending on the rules in the Proposed Auckland Unitary Plan. If your deck is more than 1m high, it must have a handrail.
A minimum 900mm (36) high guard/railing is required on the perimeter of a deck, balcony, veranda and stairs where the difference in elevation exceeds 600mm (2-0) above adjacent deck or ground level.
In many cases, a permit will be required before youre able to construct a deck. If the deck is set to be attached to your home or is considered to be 30 inches or more above grade, a building permit will be necessary.
Regardless of the decks walking surface area, if the deck is adjacent to or attached to the house and its walking surface is more than 600 mm (24 in.) above the adjacent grade, a permit is required.

Most decks require a development permit and a building permit combined into a home improvement permit. However, a development permit is not required when a deck meets all of the following: Is entirely located within a back or interior side yard.

Plans Permits Construction may only begin after the Department approves construction plans and issues permits for a deck or porch. Only an NYS licensed professional engineer (PE) or registered architect (RA) may design them.
Do I need a permit? You will need a Building Permit if: Your deck will be higher than 0.6m (approximately two feet) above grade at any point. You are building a covered deck such as an enclosed sundeck, a deck with open rafters or a gazebo (this is considered an addition and may require a Development Permit).
PROJECTS WHICH DO NOT REQUIRE A BUILDING PERMIT: Small site development - including finished grading and planting; fencing; and re-paving of existing roadways, parking lots and walkways. Bleacher projects which involve only the installation of pre-engineered, factory-built equipment without foundations or sitework.
