WHY DO I NEED ONE? Companies need Form 6166 to claim income tax treaty and other tax benefits while doing business in foreign countries. Many U.S. tax treaty partners require this proof of U.S. residency from the IRS when a person or business entity is claiming income tax treaty benefits.
Use of the Form 8802 is mandatory. Form 6166 is a letter printed on U.S. Department of Treasury stationery docHubing that the individuals or entities listed are residents of the United States for purposes of the income tax laws of the United States.
To obtain Form 6166, a letter of U.S. Residency Certification, you must submit a completed Form 8802, Application for United States Residency Certification. A user fee is charged to process all Forms 8802.
The U.S Tax Residency Certificate is obtained through Form 8802, which has much more complex instructions and must be submitted with an $85 fee. Be sure to submit Form 8802 at least 45 days before you need the certificate. If there are any issues or delays with Form 8802, the IRS will contact you after 30 days.
If you request certification under this procedure, you must submit a Form 8802 for each year, but in years 2 and 3 you only need to attach a copy of the year 1 Form 8802 (including the penalties of perjury statement), provided there are no material changes to the information entered on the Form 8802 in year 1.
Many U.S. treaty partners require U.S. citizens and U.S. residents to provide a U.S. Residency Certificate in order to claim income tax treaty benefits, and/or certain other tax benefits, in those foreign countries. The IRS provides this residency certification on Form 6166, a letter of U.S. residency certification.
You can use Form 8802 to apply for Tax Residency Certificate if one of the following applies to the year for which certification is requested: You filed an appropriate income tax return. For a certification year in which a return is not due yet, you filed a return for the most recent year that a return was due.
You can call 267-941-1000 (not a toll-free number) and select the U.S. residency option if you have questions regarding your application. Note: The IRS cannot accept an early submission for a current year Form 6166 that has a postmark date before December 1 of the prior year.
