(light music) - Theres a lot of potential consequences and harm that could come from not properly protecting a trademark, but theres really three main things that I counsel clients about that they are concerned about, should be concerned about. The first is when you dont register a trademark, you dont appear in the USPTOs database, and that means youre not taking advantage of the automatic protections and insurance that the USPTO is offering by appearing in their database because when youre in their database, the trademark office will automatically block applications that come after yours that are confusingly similar. And when youre in their database, many people are searching the database when theyre coming up with new brand names or thinking about applying for new brand names, so it may avoid situations from ever arising that the brand owner may never even find out about because they got squashed in their infancy. The second consequence of failing to protect a trademark is t

A trademark registration becomes dead when the application wasnt completed or maintained. Once you stop using the trademark, your trademark rights become abandoned, creating an opportunity for someone else to acquire the rights.
When a trademark is abandoned, the trademark owner may no longer claim rights to the trademark. In effect, this frees the trademark so that anyone else can use it without recourse from the original trademark owner.
Trademark Invalidation If the registration is less than five years old, the party challenging the trademark rights can rely on any ground that could have prevented registration initially. The likelihood of confusion and descriptiveness is the most common grounds asserted to invalidate trademark rights.
Unlike patents and copyrights, trademarks do not expire after a set period of time. Trademarks will persist so long as the owner continues to use the trademark. Once the United States Patent and Trademark Office (USPTO), grants a registered trademark, the owner must continue to use the trademark in ordinary commerce.
To claim the dead trademark you will need to complete an application with the USPTO. Provide your name and address, the name of the dead mark, a statement as to the goods and services that you wish to sell under the mark and a statement as to whether you have attempted to register the mark previously.
Fanciful marks comprise terms that have been invented for the sole purpose of functioning as a trademark or service mark. Such marks comprise words that are either unknown in the language (e.g., PEPSI, KODAK, and EXXON) or are completely out of common usage (e.g., FLIVVER).
Weak trademarks are hard to protect against competitors and often are not federally registrable. These include descriptive and generic trademarks. Descriptive trademarks merely describe some aspect of your goods or services without identifying or distinguishing the source of those goods or services.
You will have to file a petition with the United States Patent and Trademark Office (USPTO) to revive the application within two months after the Notice of Abandonment has been posted and within six months after the USPTO electronically posts that the application has been abandoned.
