Adverse Possession means someone occupying land belonging to someone else, without permission. If someone does this continuously for a number of years (normally 10 or 12 years) then, in certain circumstances, the land may become theirs.
Collector of Taxes may seize (distain) the goods and chattel or the personal property of person or persons liable for property taxes.
Generally speaking, if you have been occupying lands that you do not own, rent or otherwise have permission to use in excess of 12 years (or in the case of Crown lands 30 years), without any objection from the registered owner, you can claim what is known as adverse possession.
To claim Adverse Possession you must show that: You have actual physical possession of the land. You have the intention to possess the land. Your possession is without the true owners consent. All of the above have been true for at least 12 years if the land is unregistered or 10 years if the land is registered.
The conditions under which you can claim legal title to the land are as follows: If the land is unregistered, the individual(s) must show they have treated it as their own for 12 years without the legal owners consent. No application needs to be made.
Under Washington State law, an adverse possessor can only claim right to the property after 10 years of use and possession. If the possessor is paying the property taxes on that piece of land, the time period can be reduced to 7 years. Display continuous and uninterrupted use.
Any 1st payment made after the 30th of April are considered late. Such payments may attract a ten percent (10%) penalty. Amounts unpaid after thirty (30) days from the 30th of April may attract a further fifteen percent (15%) penalty per annum.
