Definition of a Lease A lease is defined as a contract that conveys control of the right to use another entitys nonfinancial asset (the underlying asset) as specified in the contract for a period of time in an exchange or exchange-like transaction.
The lessor reports the lease as a leased asset on the balance sheet and individual lease payments as income on the income and cash flow statements. The lessee reports the lease as both an asset and a liability on the balance sheet due to their stake as a potential owner of the asset and their required payment.
Simply put, an embedded lease is a lease within a larger contract or arrangement. Under previous guidance, operating leases and service contracts were expensed to the income statement, and there was no balance sheet recognition.
Simply put, embedded leases are components within contracts that entail the use of a particular asset, where the user has control over that asset. You might be surprised at some of the types of contracts that often contain embedded leases, even though the contract may not contain the word lease.
The exemption criteria should be applied to underlying assets to assess their value when they are new, not the current value of the asset in question. Naturally, a brand new asset will have a different value to a much older one.
IFRS 16 Leases provides a recognition exemption whereby lessees can choose not to capitalise short-term leases on the balance sheet, and instead recognise lease payments as an expense, either on a straight-line basis, or another systematic basis, if that basis is more representative of the pattern of the lessees
The answer to that question is no. Software arrangements are not a lease because intangible assets are precluded from lease accounting.
Is Software as a Service (SaaS) considered an embedded lease? Thankfully, no. The right to use intangible assets is outside of the scope of ASC 842. For intangible assets, look to the ASC 350 for proper accounting standards.
