The Draft and WWII On September 16, 1940, the United States instituted the Selective Training and Service Act of 1940, which required all men between the ages of 21 and 45 to register for the draft. This was the first peacetime draft in United States history.
If Congress and the president authorize a draft: The Selective Service System will start calling registered men ages 18-25 for duty. The men will be called in a sequence determined by random lottery number and year of birth.

The act eventually required all men between the ages of 21 to 45 to register for military service. Under the act, approximately 24 million men registered for the draft. Of the total U.S. troops sent to Europe, 2.8 million men had been drafted, and 2 million men had volunteered.
May 1917 - Congress passes the Selective Service Act, establishing local, district, state, and territorial civilian boards to register men between the ages of 21 and 30 for service in World War One.
If required to register with Selective Service, failure to register is a felony punishable by a fine of up to $250,000 and/or 5 years imprisonment. Also, a person who knowingly counsels, aids, or abets another to fail to comply with the registration requirement is subject to the same penalties.
No, but Registration Acknowledgement cards are. The last time a man was drafted was in 1973. It would require an act of Congress to reinstate the draft. Most Americans over the age of 30 remember the draft card which Selective Service issued to each man at the time he registered.
