[Music] hello and welcome back to the video updates its chad again todays video is going to cover the question that we get from heirs that are trying to assume a mortgage that was taken out by their ancestor or deceased relative so typically the type of mortgage that was taken out would have been a reverse mortgage sometimes its a home equity loan or home equity line of credit or just a regular mortgage and then when the person passes away and the heirs sometimes would hire an estate planning lawyer or a probate lawyer to sort out the inheritance the probate lawyers will file whatever is needed to be able to get the will admitted to probate if there is a will and they will then go through all the different steps to get to the end of the case the will would name an executor or representative and so the court would issue some documents called letters testamentary and those letters would name the powers of the executor in there there will also be a document called an order to appoint

The executor is responsible for distributing all assets following the will. This includes arranging for payment of any debts and inheritance tax that may be due, distributing the estate to all beneficiaries named in the will, and settling any other outstanding issues.
In many cases, if most of the assets have been collected then an interim payment can be made to the beneficiaries, as long as enough funds are kept back to cover any outstanding costs. Once these final costs or disbursements have been paid, the remaining funds can be distributed to the beneficiaries.

The trustee can transfer real estate to the beneficiary by having a new deed written up or selling the property and giving them the money, writing them a check or giving them cash.
Typically, fees such as fiduciary, attorney, executor, and estate taxes are paid first, followed by burial and funeral costs. If the deceased members family was dependent on him or her for living expenses, they will receive a family allowance to cover expenses. The next priority is federal taxes.
