Is it illegal for an employee to publicly discuss salary? There is no specific law in Canada that prevents employees from publicly discussing their salary or compensation. Therefore, its not illegal for a worker to share how much income they earn from their job.
Under the National Labor Relations Act (NLRA or the Act), employees have the right to communicate with other employees at their workplace about their wages. Wages are a vital term and condition of employment, and discussions of wages are often preliminary to organizing or other actions for mutual aid or protection.
You cannot forbid employees either verbally or in written policy from discussing salaries or other job conditions among themselves. Discussing salary at work is protected regardless of whether employees are talking to each other in person or through social media.
When you and another employee have a conversation or communication about your pay, it is unlawful for your employer to punish or retaliate against you in any way for having that conversation.
Employers should not automatically assume that salary details are confidential information. Disclosing such information is not necessarily grounds for disciplinary action unless there is explicit wording in the employees contract that prohibits such conduct.
There is a common misconception among employees that you cannot discuss your pay with others. In fact, employees right to discuss their salary is protected by law.
Additionally, it is unlawful for the employer to have a work rule, policy, or hiring agreement that prohibits employees from discussing their wages with each other or that requires you to get the employers permission to have such discussions.
