If a landlord does not return the entire amount of the tenants security deposit within the 21 days required by law, and the tenant disputes the deductions from the deposit: The tenant can write a letter to the landlord explaining why he or she believes he or she is entitled to a larger refund.
If you have lived in the home for more than two years, more than likely the home will need to be painted, and per California law, it would be the responsibility of the owner. The exception would be if you maliciously damage the walls or painted the walls a different color.
You can get your deposit back by suing in small claims court. If the landlord misses the 21-day deadline, he forfeits the right to deduct anything. If he keeps the money in bad faith, you can sue for up to 3 times the amount of the deposit. The process is quick, easy, and inexpensive.

Your landlord can deduct from your security deposit for unpaid rent, cleaning fees and repairs to damages outside of normal wear and tear. Here are some examples of things for which a landlord can deduct.
A landlord can only charge tenants for the cost of painting what goes beyond normal wear-and-tear. For example, a landlord could not charge their tenant the full cost of repainting the entire apartment if they left it in good condition after renting for just one year.
Once you and your boxes and furniture are gone, your landlord has to return your deposit within 21 days, under California law. (Thats three calendar weeks not 21 business days.)
Although in California landlords are required to make their rental properties habitable, they do not have to repaint (save for some conditions such as lead paint removal). Most landlords repaint every three to five years to keep their properties looking fresh and well-kept.
