A security deposit should not be used as a final months rent. At the end of the lease, if the tenant honored the terms and conditions of the lease and left the apartment in the same condition as it was when initially rented, except for normal wear, the owner must return the full security deposit.
So when we talk about no lease, what we really mean is no written lease. And, although the tenant still has rights under the law, the absence of clarity surrounding the terms and conditions of the tenancy can lead to disputes and confusion. But it does not mean the eviction process is any less stringent.
30-days Notice: If you want to evict a month-to-month renter with no lease in place, you must give 30-days notice before you ask for eviction.

The average is one months rent, but some will charge up to three months rent. Most states have a limit to what can be charged, but there are some states that have no maximum. If everyone else in the area is charging one months rent for security deposit, the landlord may want to do the same, to lease the unit.
At the beginning of their tenancy, all tenants can be required to give their landlord a security deposit, but it is limited to no more than one months rent. The one-month limit means that a landlord cannot ask for last months rent and a security deposit.
Landlords are required to provide notice to tenants if they intend to raise rent more than five percent or if they do not intend to renew the lease. The landlord must provide such notice at least: 30 days in advance of renewal if a tenant has lived in the apartment less than one year and has less than a 12-month lease.
Most residential leases and rental agreements in New York require a security deposit: A dollar amount, usually one months rent, thats intended to cover damage to the premises beyond normal wear and tear, and to cushion the financial blow if a tenant skips out early on the lease without paying.
If the landlord wants to end a month-to-month tenancy, the landlord must give the tenant a 30-day notice that specifies the date on which the tenancy will end. If the tenant does not move out by that date, the landlord can file an eviction lawsuit against the tenant. (Tenn. Code 66-28-512 (2022).)
As mentioned before, technically, in most cases the security deposit is not required prior to lease signing.
