In a prenuptial agreement, full disclosure is required in relation to the assets that are owned by both parties. The agreement may include a schedule of you and your spouses assets to show that the contract was put in place with full disclosure by both parties.
Here are some of the things you may need to gather prior to getting a prenup: Income (tax returns, pay stubs) Debt (mortgage statements, car loans, medical debt bills, student loan statements, etc.) Accounts (bank account statements, retirement plan statements, investment account statements, etc.)
In Canada, prenuptial and postnuptial agreements are enforceable , but in some circumstances, the court may modify or ignore them or may set them aside if it sees them as unfair. In China, prenuptial agreements are enforceable and post-marriage nuptial agreements are also legal.
The prenup loophole is that, should the agreement come into a court setting, the only thing one side has to do is find a legitimate asset that was excluded when the agreement was executed.
Although parties are able to waive the requirement to provide disclosure and can put a clause stating this specifically in the agreement, by not providing disclosure you are still putting your agreement at risk of being challenged later on.
A prenuptial agreement does not cover the following: Child custody or visitation matters. Child support. Alimony in the event of a divorce. Day-to-day household matters. Anything prohibited by the law.
Ontarios Family Law Act permits a court to set aside a prenuptial agreement or any portion thereof if a party failed to disclose docHub assets or liabilities, if a party did not understand the nature or consequences of the contract, or otherwise, in ance with the law of contract.
