Sections 744.2, 744.3, and 744.4 prohibit exports, reexports, and transfers (in-country) of items subject to the EAR to defined nuclear, missile, and chemical and biological weapons proliferation activities.
734.2 Subject to the EAR. (a) Subject to the EAR - Definition. (1) Subject to the EAR is a term used in the EAR to describe those items and activities over which BIS exercises regulatory jurisdiction under the EAR.
The ECCN is a key factor in determining whether you need a license to export items from the United States, or to transfer controlled technology to a foreign national within the United States.
If you are not the manufacturer of the item you are exporting, the item may have already been classified by the manufacturer. One of the quickest ways to determine the ECCN of your item is to check with the manufacturer. Many companies list ECCNs on their website.
EAR99 is a classification designation for an item that is subject to the EAR but not specifically described by an ECCN on the CCL. NLR, which stands for No License Required, is a shipment designation.
An ECCN (Export Control Classification Number) is a five alpha-numeric designation for dual-use items that are listed on the Commerce Control List (CCL) to ensure these items are not for military use. An HS (Harmonized System) code is used for standardized international trade.
Unlike an EAR99 designation, which is a broad basket category, an ECCN is much more narrowly defined and are focused on product categories.
Contact the manufacturer, producer, or developer of the item you are exporting to see if they have classified their product and can provide you with the ECCN. If they have exported the item in the past, it is likely they have the ECCN.
For each item that may have an export control, the ECCN must be identified before the item can be shipped as this is the only way to be ensure the export is in compliance with current export regulations.
c and 5D992. c item does not require a license exception to go to most places (because it is only Anti-Terrorism controlled) they are described in License Exception ENC 740.17, which includes the submission requirements that need to be made to BIS. Whether an item is 5x002 or 5x992.
