U.S. government officials, similar to those in the U.K. and Australia, have deemed that AI cannot be named an inventor. However, if a human being has sufficient involvement in the creation of the work in question, then the output may be considered eligible for a patent protection by naming the person an inventor.
As I explained in an August 2022 TechTank post, the Federal Circuits decision that month in Thaler v. Vidal made clear that the definition in the Patent Act of inventor requires that inventors be human. Therefore, under current patent law, naming AI systems as inventors isnt possible.
AI/ML subject matter becomes patent-eligible only when it achieves a technical purpose and, at minimum, offers a technical effect that does more than performing the solution more quickly or efficiently. The general application of AI/ML to solve a problem predictably is not eligible for patentability.
As AI does not have legal personhood, it is currently not recognized as a holder of any (intellectual property) rights.
Last year, in the case of Thaler v. Vidal, the Federal Circuit affirmed that only natural persons (i.e., human beings) can be named inventors on U.S. patents, thereby excluding artificial intelligence from being listed as an inventor per se.
Furthermore, AI can improve the accuracy and speed of design and construction processes. Machine learning algorithms can analyze historical data to optimize building designs for energy efficiency and cost savings. Robotics and automation can also improve construction speed and quality.
