It is not illegal to alter a contract once it has been signed. However, it must be materially changed, meaning that if an important part of the contract is altered by the change, it must be made by mutual consent of both parties.
A written contract can, however, be re- scmded or modified by a subsequent oral contract unless the subject matter of the contract as modified is within the statute of frauds.
Emails can create contracts and now texts are following suit. Indeed, both businesses as well as consumers are often quite surprised, and in some cases quite alarmed, to learn that seemingly casual conversation, can create a legally binding contract if it contains relevant language.
Under common law, a party to a contract needs new consideration -- something of legal value -- to modify a contract. The party obtains new consideration by negotiating with the other party to change the consideration on both sides of the contract. Two exceptions to the general rule apply.
A text message can be a legal document under the ESIGN Act, which gives contracts signed electronically the same weight as paper and ink contracts.
Changing the Contract This often depends on the company and those involved in the terms of employment. If the possibility exists, the person can renegotiate the contract by changing it from a short-term employment period to a long-term or full-time situation. Other aspects are also available based on this change.
Whether a text message can change a contract, or even form a contract, between parties is still up for substantial debate in courts around the U.S. Typically, it depends on the terms of the contract, state law, the content of the text messages and the conduct of the parties.
Text messaging leaves an electronic record of dialogue that can be entered as evidence in court. Like other forms of written evidence, text messages must be authenticated in order to be admitted (see this article on admissibility by Steve Good).
An employer that amends a contract without your consent has no right to enforce the amended contract terms. In some instances, you can take the employer to court for bdocHub of the original contract and recover damages. Serious legal consequences await any party that changes the terms without the other partys consent.
You can modify a contract at any time as long as all parties involved in the agreement consent to the changes.
