The act had three objectives: to create a market for war bonds, to reestablish the central banking system destroyed during President Andrew Jacksons administration, and to develop a stable bank-note currency.
The intent of the National Bank law was that the old state banks would convert to national charters. But not all of them did, so Congress in 1865 passed a prohibitive tax on state bank notes. That ended the issue of state bank notes.
In order to assist with the war debt, national banks had to purchase government bonds as security, and then they could start issuing their own loans and notes. The act also standardized the printing and issuing of American currency; the U.S. dollar became the accepted national currency.
For a time in U.S. history, entry into banking in some states was thrown wide open. The so-called free-banking era from 1837 to 1864 was also a time of numerous bank failures in those states. But exactly what lesson does this colorful yet costly period hold for us today?
Between 1836 and the onset of the Civil Wara period known as the Free Banking Erastates allowed virtual free entry into banking with minimal regulation. Throughout the period, banks failed frequently, and several banking panics occurred.
Thomas Jefferson believed this national bank was unconstitutional. In contrast to Hamilton, Jefferson believed that states should charter their own banks and that a national bank unfairly favored wealthy businessmen in urban areas over farmers in the country.
On February 25, 1863, President Lincoln signed The National Currency Act into law. The Act established the Office of the Comptroller of the Currency (OCC), charged with responsibility for organizing and administering a system of nationally chartered banks and a uniform national currency.
As the economic depression deepened in the early 30s, and as farmers had less and less money to spend in town, banks began to fail at alarming rates. During the 20s, there was an average of 70 banks failing each year nationally. After the crash during the first 10 months of 1930, 744 banks failed 10 times as many.
Jefferson worried that a national bank would give too much power to the government and to wealthy investors who would help run the bank. apou Differing Views: Jefferson vs. Hamilton Jefferson opposed the law setting up the bank. He claimed that it was unconstitutional, or not permitted by the Constitution.
In all, 9,000 banks failed--taking with them $7 billion in depositors assets. And in the 1930s there was no such thing as deposit insurance--this was a New Deal reform. When a bank failed the depositors were simply left without a penny. The life savings of millions of Americans were wiped out by the bank failures.
