Civil Code 1951.2 says that if you leave, you owe the rent for the rest of the lease term MINUS what YOU can prove the landlord COULD HAVE AVOIDED LOSING. The landlord also has a common law duty to minimize his losses [mitigate damages].
The tenant is required to fill out a form called a Motion to Set Aside an Ex Parte Order and submit it to the Landlord and Tenant Board office within 10 days from when the Order was issued. This 10-day period includes weekends and holidays. Once this form is filed, the Board will schedule a new hearing date.
Although some people believe evictions cannot take place during the winter months, a landlord can evict a tenant anytime if the reasons for the eviction fall under the Residential Tenancies Act and by following the eviction procedures as set out in the Act.
