Before barbed wire, the cattle grazed on open ranges, which large ranchers often claimed as their owneven without a legal basis. Those land barons eventually filed claims with government land offices (after surveying).
The new law established a three-fold homestead acquisition process: file an application, improve the land, and file for deed of title. Any U.S. citizen, or intended citizen, who had never borne arms against the U.S. Government could file an application and lay claim to 160 acres of surveyed Government land.
In eighteen sixty-two, Congress had passed the Homestead Act. This law gave every citizen, and every foreigner who asked for citizenship, the right to claim government land. Nearly four million homesteaders settled land across 30 states over 123 years. The Homestead Act of 1862 allowed anyone over 21 years of age or the head of a household to apply for free federal land with two simple stipulations: Be a citizen of the United States or legally declare their intent to become one.

In 1862 congress passed the homestead act offering 160 acres of free land to any citizen or intended citizen who was head of the household.
The good news is that homesteading is legal in Montana. Homesteading in the state dates back to the Homestead Act of 1862, enabling US citizens to claim land provided that they lived on it, cultivated it, and improved it.
The incentive to move and settle on Western territory was open to all U.S. citizens, or intended citizens, and resulted in 4 million homestead claims, although 1.6 million deeds in 30 states were actually officially obtained. Montana, followed by North Dakota, Colorado and Nebraska had the most successful claims.
The most docHub was the Enlarged Homestead Act of 1909, which doubled the free land available to settlers to 320 acres.
