Can your employer reduce your hours, or lay you off? The short answer is only if your employment contract allows it. If not, your employer will have to negotiate a change to your contract.
It is not illegal to alter a contract once it has been signed. However, it must be materially changed, meaning that if an important part of the contract is altered by the change, it must be made by mutual consent of both parties.
An amendment is typically used to change something thats part of an original contract. Think of amendments as modifications to the earliest agreement (for example, altering an agreed-upon deadline). An addendum is used to clarify and add things that were not initially part of the original contract or agreement.
Modifications to a contract can essentially take place at any time, assuming that all parties are in agreement, although it is easier to make modifications before the contract has been signed.
How employment contract changes can be agreed a change is proposed by either you, or one or more employees or workers, which you then discuss and agree with them. you have a collective agreement with a trade union and the union agrees changes to terms and conditions on behalf of your employees or workers.
Your employer isnt entitled to simply bring in any change they wish. If your employer tries to make a change that you dont agree with (for example trying to demote you or cut your pay), tell them immediately. Put your objections in writing, asking for reasons for the change and explaining why you dont agree.
Unless your employment contract expressly allows unpaid or reduced pay lay-offs or short-time working, or you agree to any reduction, your employer is not legally permitted to cut your pay.
There is a legal implication in changing payment terms on invoices that already have been issued. Whether the invoice is under an umbrella sales contract or a single separate invoiceit is a contract and you may not be able to change or alter unilaterally.
Your employer should only make a change to your contract if at least one of these applies: you agree to the change. your contract says your employer can make certain changes - this is called a variation clause the law is changing - for example if you get the National Minimum Wage and the rate changes.
If you dont agree with changes to your employment conditions. If you dont agree, your employer is not allowed to just bring in a change. However, they can terminate your contract (by giving notice) and offer you a new one including the revised terms - effectively sacking you and taking you back on.
