ADS-B Out equipment is required to operate in the airspace defined in 14 CFR 91.225. If you never fly into ADS-B-designated airspace, then there is no requirement to equip.
As described in 14 CFR 91.225, ADS-B Out performance is required to operate in: Class A, B, and C airspace. Above the ceiling and within the lateral boundaries of a Class B or Class C airspace area upward to 10,000 feet MSL .
Per 14 CFR 91.227 and 91.225, each person operating an aircraft equipped with ADS-B Out must operate this equipment in the transmit mode at all times, unless authorized by the FAA or directed by air traffic control (ATC).
Unless otherwise authorized by ATC, all aircraft within Class B airspace must be equipped with the applicable operating transponder and automatic altitude reporting equipment specified in 14 CFR part 91, section 91.215(a) and an operable two-way radio capable of communications with ATC on appropriate frequencies for
Pilots/operators using aircraft that do not meet ADS-B Out equipage or performance requirements may request an authorization to deviate from the rule to access ADS-B Out rule airspace. The FAA has developed the ADS-B Deviation Authorization Preflight Tool (ADAPT) to manage these authorization requests.
ADS-B is required in Class A, B and C airspace within U.S. domestic airspace and all land mass regions of the U.S. as defined in 14 CFR 1.1 and it includes the states (contiguous and non-contiguous), U.S. possessions, or territories.
ADS-B Out works by broadcasting information about an aircrafts GPS location, altitude, ground speed and other data to ground stations and other aircraft, once per second. Air traffic controllers and properly equipped aircraft can immediately receive this information.
Class A: ADS-B is required at all altitudes. Class B: Required from the surface to 10,000 feet Mean Sea Level (MSL), including airspace from Class Bravo that extends beyond the Mode C Veil up to 10,000 feet MSL (such as at LAX and LAS).
The FAA requires ADS-B Out capability in the continental United States, in the ADS-B rule airspace designated by FAR 91.225: Class A, B, and C airspace; Class E airspace at or above 10,000 feet msl, excluding airspace at and below 2,500 feet agl; Within 30 nautical miles of a Class B primary airport (the Mode C veil);
Aircraft operating in Class A airspace are required to have ADS-B Out equipment installed that operates on the frequency of 1090 MHz.
