The Law Enforcement Officers Safety Act (LEOSA), often referred to as HR 218, allows qualified Law Enforcement officers (LEOs) and qualified retired LEOs (RLEOs) to concealed carry in any jurisdiction in the United States, regardless of state or local laws, with some exceptions.
The Circuit Court recognized Congresss unambiguous conferral of an individual right and its clear intent to preempt state law. In LEOSA, Congress granted certain retired law enforcement officers a right to carry a concealed firearm, and LEOSA expressly preempts contrary provisions of state law.
A retired law enforcement officer must qualify twice per calendar year, minimum three months apart, as per the New Jersey Attorney Generals guidelines. Both initial and renewal application require submission of one recent training record of the qualification undertaken within six months prior to date of application.
