Form 1310 is a tax form that is filed with the IRS to request a tax refund for a deceased individual. This form is typically filed by a surviving spouse, another beneficiary, or the executor of the deceaseds estate.
On the final tax return, the surviving spouse or representative should note that the person has died. The IRS doesnt need a copy of the death certificate or other proof of death. Usually, the representative filing the final tax return is named in the persons will or appointed by a court.
Generally, if the return was completed correctly. taxpayers expecting refunds that filed electronically can expect a deposit within 10 to 14 business days. Taxpayers expecting a refund that filed using a paper form should allow at least 16 to 20 weeks to receive a refund back by mail.
IMPORTANT: Complete a RF-9 form for each tax year and each refund type. Also enclose proof of death with each return. Refer to the instructions on the reverse to complete an accurate claim for refund on behalf of a decedent.
To get the refund, you must complete and attach Form 1310 to your fathers final return. You should check the box on Form 1310, line C; answer all the questions in Part II; and sign your name in Part III. You must also keep a copy of the death certificate or other proof of death for your records.
