In general. If you are a citizen or resident of the United States, you must file a gift tax return (whether or not any tax is ultimately due) in the following situations. If you gave gifts to someone in 2024 totaling more than $18,000 (other than to your spouse), you probably must file Form 709.
Certain gifts necessitate a Form 709 to make a specific gift tax election, regardless of the amount gifted or the amount of exemption used. In some cases, the IRS requires a timely filed Form 709 as the only proper method for a taxpayer to make such elections.
The government requires this to keep track of your lifetime gift and estate tax exemption. Its only when you use up the large lifetime exemption that you would owe an out-of-pocket tax. Still, filling out Form 709 can get complicated.
There are two options for getting started with e-filing: Option 1 Authorize a reporting agent to prepare, sign and e-file the Form 709 return for you. Option 2 Become an authorized e-file provider by completing the IRS e-file application and choosing the provider role(s) that meet your needs.
The giver will generally file a gift tax return when the gift exceeds the annual gift tax exclusion amount, which is $18,000 per recipient for 2024 (the annual gift tax exclusion for 2025 is $19,000.) This means a giver can give up to $18,000 per recipient per year without being required to file a gift tax return.
