Report on Form 1099-MISC or Form 1099-NEC only when payments are made in the course of your trade or business. Personal payments are not reportable. You are engaged in a trade or business if you operate for gain or profit.
Form 1099-MISC is used to report payments made to others in the course of a trade or business, not including those made to employees or for nonemployee compensation. Form 1099-NEC is used to report nonemployee compensation for services rendered in the course of business to a partnership, estate, or individual.
Youll usually report this income on Form 1040, Line 21, as Other income. This is taxable income not subject to self-employment tax. When the income reported on Form 1099-MISC Box 3 is from your trade or business, report it with your business income.
If you receive a Form 1099-MISC or Form 1099-NEC that reports your miscellaneous income, that information also goes to the IRS. If you dont include this and any other taxable income on your tax return, you may be subject to a penalty. Failing to report income may cause your return to understate your tax liability.
Form 1099-MISC reports for various payments, like rent or prizes, that arent subject to self-employment tax. Form 1099-NEC reports nonemployee compensation, such as payments to independent contractors.
