The employer maintaining the plan or the plan administrator of a Pension or Welfare benefit plan covered by ERISA. File Form 5500 to report information on the qualification of the plan, its financial condition, investments and the operations of the plan.
As noted above, private-sector plans with fewer than 100 participants that are either fully insured or self-insured with benefits paid directly from the general assets of the employer or employee organization that sponsors the plan, rather than from a trust, are not generally required to file a Form 5500.
One-participant plans that cover a business owner and a spouse, but no other employees, may require Form 5500-EZ. If the total plan assets are $250,000 or less, filing is not necessary. Those who do have to file Form 5500-EZ can do so either electronically or by mail.
First, check with the third-party administrator (TPA) or your investment provider for your plan as this will be the easiest option. Otherwise, you can obtain IRS Form 5500 for the prior year at the DOL website. The DOL search engine identifies Form 5500 and 5500-SF filings received by EFAST2.
