Interim spousal support is owed from the date the spouse seeking it files their request with the Court, usually. As it is temporary, it ends 180 days after the judgment of divorce, except that it can be extended for good cause. The obligation to pay interim spousal support ends upon the death of either spouse.
Louisiana Civil Code Art. 113 provides: A. Upon motion of a party, the court may award a party interim spousal support based on the needs of that party, the ability of the other party to pay, any interim or final child support obligation, and the standard of living of the parties during the marriage.
In each case, a judge must consider several factors to determine if spousal support should be paid, including: The financial means, needs and circumstances of both spouses; The length of time the spouses have lived together; The roles of each spouse during their marriage;
Periodic payments are bi-weekly, monthly, or semi-annual and will not exceed 30% of the paying spouses net income. However, if the court finds that the paying spouse committed domestic violence during the marriage, the judge can order the final award to exceed 30% and award it as a lump-sum payment.
Under Louisiana law, marital property, or property acquired during the marriage, is distributed equally (50-50) to each party unless the court finds such a division to be inequitable or parties agree to a different formula under which to divide property.
