Under North Carolina law, any business that seeks to use a name other than the name of its owners, or other than the name under which it was formed, must file for a DBA. Specifically, such businesses will need to file an Assumed Business Name Certificate with the Register of Deeds Office in its local county.
Assumed Business Name Act Assumed Business Names filed prior to December 1, 2017, expired on December 1, 2022. Owners desiring to engage in business in North Carolina after that date must file a new Assumed Business Name Certificate per NCGS 66-71.15.
You can file an assumed business name certificate in your local register of deeds office. Your certificate will be recorded and indexed in that county. It will also be uploaded to a statewide database of assumed business name information housed at the NC Secretary of States office.
N.C.G.S 66-71.4(a) requires that any person engaging in business in this State under an assumed business name, the person must file an assumed business name certificate in the office of the register of deeds of the county in which the person is or will be engaged in business.
The DBA cost in North Carolina is $26. DBAs do not expire in North Carolina and do not require renewal. You can pay your DBA filing fees in North Carolina using a credit card or debit card. Your local County Register of Deeds will advise if they allow cash payments if you file in person.
