An individual must demonstrate legal residence in Virginia with an intent to remain in Virginia indefinitely to establish domicile in Virginia. After meeting the requirements to establish domicile, a person must continue to be domiciled in Virginia for at least 12 months preceding the first day of classes.
In essence, domicile has two parts and you must meet both to qualify for in-state tuition. You must reside in Virginia and you must intend to keep Virginia as your home, indefinitely. The revised domicile brochure will provide more clarification.
The Code of Virginia distinguishes between being a resident and being a domicile of Virginia. A domicile is entitled to in-state educational privileges as a benefit of that status. A resident of Virginia (unless an honorably discharged military member, veteran or active-duty member of the military) is not.
An applicant may apply for in-state privileges based upon their own domicile or the domicile of a parent, spouse, legal guardian, or individual acting in loco parentis. Domicile and resident are defined differently under Virginia law. Note that mere residency in Virginia does not qualify under the statute.
All that said, IN GENERAL having one parent a long-time resident taxpayer generally qualifies you for In State tuition. You still need to check. It sometimes gets murky, such as when the parent is a resident but not a taxpayer (military).
