The American Opportunity Tax Credit may be claimed for a student who (1) is enrolled in 6 credits or more, (2) is in one of the first four years of post-secondary education, (3) is enrolled in a program leading to a degree or certificate, and (4) is free of any conviction for a Federal or State felony offense
Use IRS Form 8863 to calculate both the American Opportunity Tax Credit and Lifetime Learning Tax Credit (including the refundable portion of the American Opportunity Credit). While you cant claim both credits in the same year for the same student, you can claim both credits in the same year for different students.
In either scenario if the student is enrolled in an eligible education institution for a degree they can claim the American Opportunity Credit which is more advantageous than the Lifetime Learning Credit as long as the student is not claimed as a dependent.
