An overpayment is caused when Texas Workforce Commission (TWC) pays unemployment benefits that you were not eligible to receive. State law requires TWC to recover all unemployment benefits overpayments. There is no statute of limitations on debts owed to the state.
For example, if you miss ten days of work, you multiply the number of hours you work each day by your hourly rate and finally by the number ten for ten lost days of work. If a worker misses ten work days, generally earns $20 an hour, and works 8 hours per day, their lost hourly wages are $20 x 8 x 10 = $1,600.
If you are owed $5000 in unpaid wages, you will also be entitled to collect an additional $5000 in liquidated damages. This means that your total unpaid wages claim can be as much as $10,000. You may also be able to claim additional damages for attorneys fees and court fees.
