An extension of time to file a franchise tax report will be tentatively granted upon receipt of an appropriate timely online extension payment or request on a form provided by the Comptroller. Timely means the request is received or postmarked on or before the due date of the original report.
To get the extra time, you must: 1. Properly estimate your 2024 tax liability using the information available to you, 2. Enter your total tax liability on line 4 of Form 4868, and 3. File Form 4868 by the regular due date of your return.
The extension payment must be at least 90 percent of the tax that will be due with the report filed on or before Nov. 15, or 100 percent of the tax reported as due on the prior franchise tax report (provided the prior report was filed on or before May 14 of the year for which the extension is requested).

Form 05-164 is the only extension form youll use to request the 1st or 2nd extension for the Texas Franchise Tax. To print the extension and filing instructions for Texas Form 05-164, youll need to activate the state, enable the extension, enter payment information and e-file information.
