Guardianship. A guardianship is established by a court after a petition for an appointment of a guardian is filed by either the incompetent person (incompetent is the term used to describe those who lack the capacity to manage themselves and their affairs) or another person.
No, guardianship does not automatically override parental rights. However, there can be situations where a guardians decisions may take precedence if a court agrees that they are in the wards best interest. Conversely, parental rights can be reinstated under improved conditions.
The Mississippi guardianship may require the above responsibilities permanently if the ward is incapacitated for the rest of their life. If the court awards temporary Mississippi guardianships, the responsibilities will end, for example, when the child turns 18.
Guardianships are normally perpetual as long as the client remains legally incapacitated and as long as the guardian remains competent and meets the statutory requirements. Only an order of the court that initially established the guardianship can terminate it.
