Commonly Asked Questions about Interrogatory Forms

In law, interrogatories (also known as requests for further information) are a formal set of written questions propounded by one litigant and required to be answered by an adversary in order to clarify matters of fact and help to determine in advance what facts will be presented at any trial in the case.
Unlike form interrogatories that focus on common questions, special interrogatories concentrate on specific questions that help obtain specific information about the case. The party must craft specific questions to establish a point that the other party must prove or disprove.
How many questions can I ask? If your case is a limited civil case ($35,000 or less) you can request up to a total of 35 combined request for admissions, form interrogatories , special interrogatories, and requests for production.
If your case is an unlimited civil case (over $35,000) you may ask up to 35 special interrogatories, but may ask more with a declaration explaining the need for additional requests and a statement that the request is not done for an improper purpose.
How to fill out Form Interrogatories Fill in basic information at the top of the form. Provide basic information about your case. Select the questions. On Page 2, check the box next to each question you want to ask your spouse to answer. Make copies. Make 1 copy of the completed Form Interrogatories Family Law.
Draft Interrogatories Strategically Only ask specific questions that address the crux of the matter where possible. Avoid board or vague questions. The opposing partys legal team may simply file objections against these, citing irrelevance, wasting your time. Also, ask questions sequentially.
Interrogatories allow the parties to ask who, what, when, where and why questions, making them a good method for obtaining new information in a case. There are two types of interrogatories: form interrogatories and special interrogatories.
(a) Interrogatories are written questions prepared by a party to an action that are sent to any other party in the action to be answered under oath.
