Commonly Asked Questions about Indiana Landlord Tenant Notices

When Indiana landlords and tenants enter into a lease (usually for one year), the landlord cannot raise the rent or change the lease in any way during the term of the lease unless otherwise stated in the lease or agreed to in a writing signed by the landlord and tenant.
Only the sheriff is allowed to remove the tenant by force. Even if the landlord wins the case, they are not allowed to engage in illegal methods of eviction. In the state of Indiana, landlords have to get a court order before disposing of or moving any belongings left behind by the tenant.
Code 32-31-1-6. If a tenant refuses or neglects to pay rent when due, a landlord may terminate the lease with not less than ten (10) days notice to the tenant unless: (1) the parties otherwise agreed; or (2) the tenant pays the rent in full before the notice period expires.
For non-payment of rent evictions, you must first provide the 10-day notice to cure or quit. The next step is to go to the township court in the county in which your property is located. The Clerk of the Court will schedule a hearing. You must then arrange for the tenant to be formally served a notice of a lawsuit.
1. Landlord Serves an Eviction Notice. If any of the above lease violations occur, the landlord must first serve an Indiana eviction notice and state that the tenant has the appropriate number of days to remedy or cure the violation.
Proper service procedure includes sending summons by mail, delivering summons in person, or leaving the summons at the tenants home. The landlord should then complete a Proof of Claim.
Landlords must give a 30-day notice before asking a tenant to vacate the property. If the landlord is asking them to move out because of a lease violation, they only need to give the tenant a 10-day notice.
